Relative is Too Sick to Take Care of Herself!

Many
people, perhaps because of old-age dementia, but also
young people suffering from physical and mental diseases,
cannot take care of themselves or of their financial
affairs. Concerned relatives or friends can ask the
Court to appoint a Conservator or Guardian to take
care of them.
There are two types of Conservatorships: of the Estate and of the
Person. A Conservator of the Estate takes control of the conservatee’s
financial affairs, but the conservatee is otherwise free to make
decisions about his or her life. A Conservator of the Person takes
more complete control of the conservatee’s life, including the right
to make health care decisions and to institutionalize the conservatee.
It is not easy to be appointed a conservator. A judge must be convinced
that the conservatee truly cannot care for him or herself. That often
requires the testimony of a physician and an investigation by a social
worker.
